1. Agreement to Terms

By opting into T-Shirts Ink SMS/MMS messaging, providing your mobile phone number to T-Shirts Ink, or continuing to use our SMS/MMS services after being notified of changes to these Terms and Conditions, you agree to be bound by these Terms and Conditions (the "Agreement").

If you do not agree to these Terms and Conditions, please do not opt into our messaging program and do not provide your phone number to T-Shirts Ink.

T-Shirts Ink reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website or notification via SMS/MMS. Your continued use of our SMS/MMS services following such notification constitutes your acceptance of the modified Terms and Conditions.

2. Definitions

"T-Shirts Ink" or "Company" means T-Shirts Ink, the custom apparel decoration business based in Moscow, Idaho.

"You" or "Customer" means any individual who opts into our SMS/MMS messaging service and provides their mobile phone number.

"SMS/MMS Service" or "Service" means the text message and multimedia message communication services provided by T-Shirts Ink through our messaging platform.

"Message" means any SMS (short message service) or MMS (multimedia message service) sent to your mobile phone number.

"Transactional Messages" means non-promotional messages related to your account, orders, or customer service (e.g., confirmations, tracking, 2FA codes, invoices, support responses).

"Marketing Messages" means promotional and non-transactional messages including offers, discounts, product announcements, and re-engagement campaigns.

"Carrier" means your wireless service provider (e.g., Verizon, AT&T, T-Mobile, US Cellular).

"Mobile Phone Number" means the cellular phone number you provide to T-Shirts Ink for SMS/MMS messaging.

3. Service Description

3.1 Purpose of Service

T-Shirts Ink SMS/MMS Service is designed to deliver transactional messages related to your orders and account, as well as marketing messages (if you have opted in) regarding promotions and company updates.

3.2 Transactional Messages

Transactional messages are triggered by your actions or your order status and are necessary to fulfill your orders and provide customer service. These include:

  • Order confirmations and receipts
  • Order status updates and shipment tracking
  • Artwork approval requests and design review links
  • Invoice and payment notifications
  • Two-factor authentication (2FA) codes
  • Customer support responses

Transactional messages are sent regardless of your marketing opt-in status. You may not opt out of transactional messages while maintaining an active account, though you may close your account to stop receiving them.

3.3 Marketing Messages

Marketing messages are promotional in nature and are sent only to customers who have provided explicit prior written consent. Marketing messages include seasonal promotions, new product announcements, discount codes, and re-engagement offers.

You may opt out of marketing messages at any time by replying "STOP" to any message or by contacting support@tshirtsink.com.

3.4 Service Availability

T-Shirts Ink will use commercially reasonable efforts to ensure reliable message delivery. However, message delivery depends on factors beyond our control, including:

  • Your carrier's network infrastructure and capacity
  • Your device's configuration and settings
  • Network congestion or outages
  • Carrier blackout dates or service limitations
  • Device compatibility and messaging app settings

T-Shirts Ink does not guarantee 100% delivery of messages and is not responsible for delayed, failed, or non-delivery of messages due to factors outside our control.

3.5 Service Hours

T-Shirts Ink customer support for SMS/MMS messaging is available during the following hours:

  • 9:30 AM to 5:00 PM Monday through Friday (Mountain Time, excluding holidays)

Messages may be sent at any time; however, transactional messages are prioritized during business hours. Marketing messages are typically sent during business hours to respect reasonable communication practices.

4. User Responsibilities & Obligations

4.1 Accuracy of Phone Number

You are responsible for providing an accurate, current mobile phone number and keeping your phone number information updated in your T-Shirts Ink account. If your phone number changes, you must update your account immediately to avoid service interruptions or messages being sent to incorrect recipients.

4.2 Authorized Use

Your mobile phone number is for your personal, non-commercial use. You agree that:

  • You are the authorized user of the mobile phone number you provide
  • The phone number is assigned to you by your wireless carrier
  • You have the right to provide this phone number to T-Shirts Ink
  • You will not provide the phone number of another person without their explicit written consent

If you provide another person's phone number without authorization, you may be liable for any damages resulting from unauthorized use.

4.3 Device Responsibility

You are responsible for:

  • Maintaining your mobile device in proper working condition
  • Managing your phone's messaging and data settings
  • Ensuring your device is compatible with SMS/MMS services
  • Managing your wireless plan and ensuring you have active service
  • Reviewing your wireless carrier's policies regarding messaging and data

T-Shirts Ink is not responsible for any issues related to your device or carrier service.

4.4 Compliance with Laws

You agree to use the SMS/MMS Service only in compliance with all applicable federal, state, and local laws and regulations. You specifically agree not to use the Service to:

  • Send threatening, harassing, or abusive messages
  • Impersonate another person or entity
  • Engage in fraud, deception, or illegal activity
  • Violate another person's privacy or intellectual property rights
  • Interfere with the operation of the Service or our systems
  • Spam or send unsolicited messages using our platform

4.5 Prohibited Uses

You agree not to:

  • Resell, redistribute, or transfer your access to the Service without authorization
  • Attempt to gain unauthorized access to T-Shirts Ink's messaging platform or systems
  • Use automated tools, bots, or scripts to interact with the Service
  • Reverse engineer, decompile, or attempt to discover the source code or architecture of our messaging platform
  • Use the Service in any manner that interferes with its normal operation
  • Disclose your account credentials or allow another person to access your account

5. Opt-In & Consent Requirements

5.1 Express Written Consent for Marketing

You acknowledge that T-Shirts Ink will only send marketing messages to you if you have provided explicit prior written consent. By checking the "I consent to receive SMS/MMS marketing messages" box during account creation or checkout, you are providing this consent.

5.2 Consent Records

T-Shirts Ink maintains records of your consent, including:

  • The date and method of your consent (e.g., website form, checkout)
  • The specific messages you consented to receive
  • Your opt-in status and any changes to your preferences

You may request a copy of your consent records by contacting support@tshirtsink.com.

5.3 Transactional Messages

By providing your phone number when creating an account or placing an order, you implicitly consent to receive transactional messages necessary to process your orders and provide customer service.

5.4 Changes to Consent

You may change your consent preferences at any time by:

  • Replying "STOP" to any marketing message
  • Updating your preferences in your account settings
  • Contacting support@tshirtsink.com

Your request to change your consent will be processed within 24 hours.

6. Opt-Out & Unsubscribe

6.1 How to Opt Out

To opt out of receiving marketing messages from T-Shirts Ink:

  1. Reply "STOP" to any marketing message. You will receive a confirmation within 24 hours.
  2. Update your account settings at www.tshirtsink.com/account/sms-preferences and uncheck the marketing consent box.
  3. Contact us directly at support@tshirtsink.com or 208-883-3535.

6.2 Opt-Out Confirmation

When you opt out of marketing messages:

  • Your request is immediately recorded in our system
  • You will receive an SMS/MMS confirmation of your opt-out within 24 hours
  • Marketing messages will cease within 24 hours of your request
  • Transactional messages will continue as needed for your account and orders

6.3 Transactional Messages Continue

Opting out of marketing messages does not stop transactional messages. You will continue to receive order confirmations, tracking notifications, invoices, 2FA codes, and support responses even after opting out of marketing.

6.4 Persistent Opt-Out Requests

Your opt-out request will be honored for a minimum of 18 months following your request, in compliance with TCPA regulations. After 18 months, if you place a new order and provide consent again, we may resume sending marketing messages.

6.5 Help & Support Keyword

You can reply "HELP" to any T-Shirts Ink message to receive:

  • Information about our SMS/MMS program
  • How to opt out
  • How to contact customer support
  • Links to our Privacy Policy and Terms and Conditions

7. Message & Data Rates

7.1 Standard Rates Apply

MESSAGE AND DATA RATES MAY APPLY. While T-Shirts Ink does not charge you for sending or receiving SMS/MMS messages, your wireless carrier's standard messaging and data rates apply based on your mobile service plan.

7.2 Your Carrier's Responsibility

You are responsible for any charges incurred by your wireless carrier for:

  • Receiving SMS/MMS messages from T-Shirts Ink
  • Using data to click links within our messages
  • Replying to our messages (including "STOP" and "HELP" keywords)

7.3 Carrier Plan Details

The cost of receiving messages depends on your specific wireless plan. Please check your carrier's rate plan or contact your carrier directly for:

  • The cost of SMS/MMS messages
  • Data rates and overage charges
  • Any applicable unlimited messaging plans

7.4 International Messages

If you are outside the United States and receive T-Shirts Ink messages, international messaging rates may apply. These rates are typically significantly higher than domestic rates. Contact your carrier for information about international SMS/MMS rates.

7.5 No Liability for Carrier Charges

T-Shirts Ink is not responsible for any charges, overage fees, or billing issues related to your wireless carrier's message and data rates. All disputes regarding carrier charges should be directed to your wireless carrier.

8. Message Content & Accuracy

8.1 Message Content

T-Shirts Ink will use commercially reasonable efforts to ensure that all messages contain accurate information. However, T-Shirts Ink does not guarantee the accuracy, completeness, or timeliness of any message content.

8.2 Links in Messages

Messages may contain links to:

  • T-Shirts Ink website and account portal
  • Order tracking platforms
  • Payment processors
  • Design approval tools
  • Third-party service providers

Verify all links before clicking. T-Shirts Ink is not responsible for the content, security, or functionality of third-party websites. Always confirm you are on the legitimate T-Shirts Ink website before entering sensitive information.

8.3 Phishing & Fraudulent Messages

T-Shirts Ink will never ask you to provide:

  • Your password or account credentials via SMS/MMS
  • Your credit card number or banking information via SMS/MMS
  • Your Social Security number or other sensitive personal information via SMS/MMS

If you receive a message claiming to be from T-Shirts Ink asking for sensitive information, do not respond. Report the message to support@tshirtsink.com and your wireless carrier immediately. It may be a phishing or fraud attempt.

8.4 Third-Party Content

Messages may contain promotional content, links, or offers from third-party vendors or partners. T-Shirts Ink is not responsible for the content, accuracy, or practices of third-party websites or services.

9. Disclaimers & Limitations of Liability

9.1 "As-Is" Service

The SMS/MMS Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. T-Shirts Ink disclaims all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of content
  • Reliability or uninterrupted service

9.2 No Guarantee of Delivery

T-Shirts Ink does not guarantee:

  • 100% message delivery
  • Delivery of messages within any specific timeframe
  • Message receipt or reading by the recipient
  • Absence of message delays or failures

Message delivery depends on factors outside T-Shirts Ink's control, including carrier network conditions, device settings, and compatibility.

9.3 Limitation of Liability

To the fullest extent permitted by law, T-Shirts Ink and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Lost profits, revenue, or data
  • Business interruption or loss of business opportunity
  • Damage to your device or wireless service
  • Any damages arising from message delivery failures, delays, or non-delivery
  • Any damages arising from your use of links in messages

This limitation applies even if T-Shirts Ink has been advised of the possibility of such damages.

9.4 Liability Cap

Except where prohibited by law, T-Shirts Ink's total liability to you for any claim arising out of or relating to this Agreement or the Service shall not exceed the amount you have paid to T-Shirts Ink in the 12 months preceding the claim, or $100, whichever is greater.

9.5 No Liability for Third Parties

T-Shirts Ink is not responsible for:

  • The actions or inactions of your wireless carrier
  • The functionality or security of third-party websites or services linked in messages
  • The failure of your device or service
  • Messages sent by unauthorized third parties using your phone number

10. Indemnification

You agree to indemnify, defend, and hold harmless T-Shirts Ink, its officers, directors, employees, agents, and service providers from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the SMS/MMS Service
  • Your violation of this Agreement or any applicable law
  • Your provision of another person's phone number without authorization
  • Your breach of any representation or warranty herein
  • Any claim that your phone number was provided without proper consent

11. Intellectual Property Rights

11.1 T-Shirts Ink Ownership

All content, materials, and information provided in T-Shirts Ink messages, including text, links, logos, trademarks, and designs, are the property of T-Shirts Ink or our licensors and are protected by copyright, trademark, and other intellectual property laws.

11.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to use messages received from T-Shirts Ink solely for your personal, non-commercial purposes. You may not:

  • Reproduce, distribute, or retransmit messages
  • Modify or alter messages
  • Create derivative works based on messages
  • Use messages for commercial purposes
  • Remove any copyright or proprietary notices

11.3 Third-Party Content

Messages may contain links to or references to third-party content. T-Shirts Ink does not claim ownership of third-party content and respects the intellectual property rights of others. Use of third-party content is governed by the third party's terms of service and licensing agreements.

12. Privacy & Data Protection

12.1 Privacy Policy

Your use of the SMS/MMS Service is governed by our Privacy Policy (available at www.tshirtsink.com/privacy). This Agreement incorporates the Privacy Policy by reference. In the event of any conflict between this Agreement and the Privacy Policy, the Privacy Policy shall control regarding data handling and privacy matters.

12.2 Phone Number Protection

T-Shirts Ink is committed to protecting your phone number and limiting its use as described in our Privacy Policy. Your phone number will not be sold, rented, or shared with third parties for marketing purposes, except as required by law or as described in our Privacy Policy.

12.3 Data Security

T-Shirts Ink uses industry-standard encryption and security measures to protect your phone number and message data. However, no security system is completely secure. T-Shirts Ink is not liable for any unauthorized access to or disclosure of your information due to factors beyond our control.

12.4 Compliance with Laws

T-Shirts Ink complies with the Telephone Consumer Protection Act (TCPA), state privacy laws, GDPR, and other applicable privacy and data protection regulations. Your information is handled in accordance with these laws.

13. Service Modifications & Discontinuation

13.1 Right to Modify Service

T-Shirts Ink reserves the right to:

  • Modify or discontinue the SMS/MMS Service at any time
  • Change message content, frequency, or format
  • Update or change the messaging platform or carrier
  • Add, remove, or modify message types or features

13.2 Notice of Changes

We will provide reasonable notice of material changes to the Service (typically at least 30 days) via email or SMS. Your continued use of the Service following notification of changes constitutes your acceptance of the modifications.

13.3 Service Suspension or Termination

T-Shirts Ink may suspend or terminate your access to the SMS/MMS Service if:

  • You violate this Agreement or any applicable law
  • Your carrier requests suspension or termination
  • You engage in fraud, abuse, or unauthorized use
  • Your account is closed or inactive for an extended period
  • We are required to do so by law or legal process

In the event of suspension or termination, you will be notified via email or SMS (if possible).

14. Compliance with Laws

14.1 TCPA Compliance

T-Shirts Ink complies with the Telephone Consumer Protection Act (TCPA) and Federal Communications Commission (FCC) regulations. We:

  • Obtain express written consent before sending marketing messages
  • Provide clear opt-out mechanisms in all messages
  • Respect and honor opt-out requests within 24 hours
  • Maintain consent records and do-not-call lists
  • Avoid sending messages during restricted hours

14.2 State & Local Laws

T-Shirts Ink complies with all applicable state and local laws regulating SMS/MMS messaging, telemarketing, privacy, and data protection, including:

  • California CCPA/CPRA
  • Virginia VCDPA
  • Colorado CPA
  • Connecticut CTDPA
  • Utah UCPA
  • Other state privacy and telemarketing laws

14.3 International Compliance

If you are located outside the United States, T-Shirts Ink will comply with applicable laws in your jurisdiction, including GDPR if you are in the EU.

14.4 Your Compliance Obligation

You agree to comply with all laws applicable to your use of the SMS/MMS Service, including carrier policies and regulations in your jurisdiction.

15. Dispute Resolution & Governing Law

15.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

15.2 Jurisdiction & Venue

You agree that:

  • All claims and disputes arising out of or relating to this Agreement shall be brought in the state or federal courts located in Nez Perce County, Idaho (or such other venue as permitted by law)
  • You consent to the exclusive jurisdiction and venue of these courts
  • You waive any objection to venue or inconvenient forum

15.3 Informal Dispute Resolution

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute through informal communication. Contact us at:

We will attempt to resolve the dispute within 30 days of receiving your complaint.

15.4 Arbitration Clause (Optional - Include if Applicable)

Any dispute that cannot be resolved through informal communication shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Nez Perce County, Idaho, and the arbitrator shall apply Idaho law.

15.5 Small Claims Court

Notwithstanding any other provision, you may bring claims in small claims court instead of arbitration if the claim qualifies for small claims court and you comply with all small claims court procedures and filing requirements.

16. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

This Agreement, together with our Privacy Policy and any other terms and conditions posted on our website, constitutes the entire agreement between you and T-Shirts Ink regarding the SMS/MMS Service and supersedes all prior negotiations, understandings, and agreements, whether written or oral.

19. Amendments & Updates

19.1 Right to Amend

Material changes to these Terms and Conditions will be communicated via:

19.3 Acceptance of Changes

Your continued use of the SMS/MMS Service following notice of changes constitutes your acceptance of the amended Terms and Conditions. If you do not agree with any changes, you must opt out of the Service.

20. Acknowledgment

By opting into T-Shirts Ink SMS/MMS messaging, you acknowledge that:

  1. You have read and understood this Agreement
  2. You agree to be bound by all terms and conditions herein
  3. You are the authorized user of the phone number you provided
  4. You understand that message and data rates may apply
  5. You may opt out of marketing messages at any time by replying "STOP"
  6. You understand the limitations of liability and disclaimers set forth herein
